I am going to throw this out there, can a property owner tell you that you cannot fish his or her dock, This aught to be good.

Good topic! I did have that happen to me once!
(I'm assuming you mean from a boat towards someone's dock)

The answer is NO if the waters is publicly owned by the state or town.
The dock is private property, BUT the water around and under it is NOT!

Hi Flipper, if you are on salt (tidal) land owner only ownes to the mean high water mark. you can fish from the water right up under his dock. You can't walk out on his dock and fish no matter how olng or if there is water under it or not. (His permit gives him this right.) All this UNLESS, you try to fish down the beach near the Kenedy compound or up here near the GWB compound out in kennebunkport.

I was on a lake a couple years ago and had a woman taking pictures of me pitchen under her dock, she said that it was private property, all I did was give her a laugh. then her husband came out and appologized on her behalf.

IT depends, i Have a buddy who owns land on the salmon river. Since the state built some walls/added rocks the river has changed its course and my buddy has lost over 20 feet of land in the past 50 years, Speaking with the state he technically owns that land even thought the water changed its course. If you on the water in a little canoe/kayak your fine. As far as walking his bank or into the water there I believe it would be his probably because before the rivers course changed unnaturally it was his yard Smile

this has happened to me more times than i care to remember..and everytime i was within my rights because i never set foot on the dock or shore...however as a courtesy if i see kids toys in the yar i will avoid a dock so in case i lose a hook or snag up no kids will be hurt..it is the least we can do to protect the kids.

Last year I pitched a crank under a dock and the crank got lodged in the rope to their boat, and they were sitting right there, I appologized and asked if I could stand on their dock, I had to cut the rope alittle and I offered to pay for the rope, but the gentleman looked at me and said that was the first time anybody took consideration and told me to go catch them.

While there are some of us who are courteous and respectful..there are way more people who are not and that screws it up for everyone.....if one bass fisherman makes some noise with a proerty owner then you can rest assured that anyone after that who fishes near their land will be screwed with.
